For the last 30 years Cancun and Playa del Carmen and now the Riviera Maya and Tulum and most recently the Yucatan coast have been top of the list for many foreigners to make real estate investments, whether this be their primary home, or a vacation rental property to generate income, or land banking for speculative profit. 

You will find when you begin your search for an investment property that you may be a little overwhelmed by the number of realtors there are and the number of properties for sale as the areas are still booming! You will need our help to guide you through this and make sure you only work with the very best developers, delivering top quality construction within timeframes promised.

Our advice is to choose very carefully who you are working with. Ensure they are a certified realtor who can act as your buyers agent. You may find that the majority that called themselves realtors are actually not certified nor qualified to give you the advice you need or take you through the buying process correctly. This can put your investment and hard earned money at risk.

It is very difficult for an investor if he/she does not have an experienced buyers agent working on their behalf. There are important reasons for this, firstly there is no MLS system in Mexico so you don’t know which properties are still available and which are years old listings that have never been taken down. Also, and especially in this marketplace, there are literally hundreds of developers and new projects and it is impossible to know which of these are reputable and reliable and fully funded without relying on sales to be able to build to complete construction. This meeting is intended to go over the options we sent to you, analyse the pros and cons of each property that caught your interest, answer all sort of questions and doubts you may have, and hopefully, agree on what properties are the most suitable for your needs so we can add it to our list of possible viewings.

This is the moment when we advise you to ensure your loved one or any other person who will be part of this purchase attends this meeting and offers valuable opinions, comments or questions which we will be very glad to answer.

Also, this meeting is ideal for us to invite a trusted and prestigious legal consultant/attorney to inform you and explain all legal aspects of the transaction including the trust ‘fideicomiso’. This part of the conversation is vital, because this legal consultant will be your solid and honest representative in this transaction, so please feel free to fire all your questions; we are here to make sure you are completely at ease and confident that we will solve whatever issues may come up.

Should the meeting —or a subsequent meeting before your arrival— lead to your decision on buying that property that just HAS TO BE YOURS, then we can proceed an offer or to a purchase-sale provisional agreement with a small reservation deposit from you to secure the property so that nobody else can buy it. Believe us, sometimes they are gone in a few days and if that should be your case, it could be gone before you get here! This reservation deposit takes the pressure off by taking the proper off the market and securing a price, and of course, is FULLY-REFUNDABLE, so no need to worry. This will all be clearly established in writing in the preliminary agreement offer.

Once the first steps are taken at a distance, they key date will come up: the date of your VISIT, when we will personally pick you up at the airport, welcome you to our fantastic part of the planet, show you around and share our absolute love for the Riviera Maya and all it has to offer you for both pleasure and investment opportunities.

If you have not yet made a decision or not paid a reservation deposit for a particular property, then this will be the time when we will show you all the properties on the shortlist, arrange tours with the owners/developers, and give you a general feel for the different areas.

It is important to plan a schedule where all involved can dedicate a part of the day to the tours, but also allowing time to think, ask questions, get a feel for the surroundings and hopefully be able to make a decision! We will enjoy the Mayan Caribbean together, and sample a taste of our delicious food and a cold beer or margarita where we can go over our day and thoughts.

If you have already made the decision and sent a deposit, the visit shall focus on your property and the surrounding areas and services that will make your life easier and ensure a fine return on your investment property. Of course you can also see other properties for comparison. And have no fear, if you are not fully satisfied with what you see, you can change your mind and use your reservation deposit to make a purchase offer on a property you prefer.

In both cases, this will be the time to meet your legal consultant and work on the procedures to follow up on that end.

COMPLETING A SAFE ACQUISITION

Surely the above mentioned steps will be followed by others at different points of the acquisition process:

  1. Meetings with the owner /developer
  2. Meetings with your legal consultant
  3. Attorney completes and in depth due diligence report.
  4. Signing a formal Purchase Agreement
  5. Making decisions on ways of delivering a down payment and agreeing a payment schedule with the developer which will be negotiated by your buyers agent.
  6. Or full payment for your property if it is ready to deliver
  7. Setting up of escrow account if necessary.
  8. Exchange of all required documents.
  9. Setting up of trust ‘fideicomiso’ by your attorney.
  10. Executing a power of attorney, just for this this specific purpose, so that you can progress with any legal procedures when you are away.
  11. Await for your property to be ready for you to take possession of it.
  12. Signing of Title and delivery of keys to your new home.
